Band 9 der HKW umfasst 16 Schriften der Jahre 1922 und 1923 sowie einen erst jüngst wiederentdeckten Zeitungsartikel Kelsens aus dem Jahre 1921. Neben Ausarbeitungen zum österreichischen und tschechoslowakischen Verfassungsrecht, darunter der dritte Bericht über Österreichs Verfassungslage im Jahrbuch für Öffentliches Recht, positioniert sich Kelsen einmal mehr kritisch zu Marxismus, Sozialismus und Bolschewismus. Doch im Zentrum dieser Schaffensperiode stehen drei Beiträge, die sich um Kelsens eigenen Kreis drehen: Während dieser in der berühmten Vorrede zur Zweitauflage der Hauptprobleme der Staatsrechtslehre ein Dutzend Jahre nach Erscheinen der Erstauflage die mittlerweile konsolidierte Entwicklungsgeschichte der Wiener Schule der Rechtstheorie erzählen kann und dabei die Beiträge seiner Schülerinnen und Schüler ausgiebig würdigt, sieht er sich herausgefordert - von Fritz Sander, einem seiner begabtesten Schüler, der in einer Mischung von persönlichen und sachlichen Gründen in scharfen Gegensatz zu seinem Lehrer tritt.
